Behavix Terms of Service — EU and International

Behavix Behavioral Data Panels · Version 3.0 · Dated 16 October 2026 · Effective on publication

These Terms of Service (the “Terms”) govern your use of the Behavix behavioral measurement service. Please read them carefully. They apply to participants outside the United States; participants in the United States are covered by our separate U.S. Terms of Service.

1. About these Terms

1.1 Who we are. The Service is provided by Behavix Oy, a company registered in Finland (Business ID 3416389-5), Kihokkiniitty 7, 02970 Espoo, Finland (“Behavix”, “we”, “us”). Behavix is a market research and behavioral data company.

1.2 The Service. The Behavix behavioral measurement service (the “Service”) consists of the Behavix measurement software built into the apps of our panel and audience partners (the “Behavix SDK”), the Behavix browser extensions and desktop meters, Behavix’s own research apps and Behavix Share (together, the “Research Application”), and the related Behavix websites and support channels. With your consent, the Research Application records how you use your device and digital services, as described in our Privacy Policy, and we use that information for market research and the other purposes described there.

1.3 Partners. Many participants join through the app, website or online panel of one of our partners, such as a survey, rewards or research app (the “Partner”). The Partner is named on the consent screen through which you joined. Your account with the Partner, and any rewards the Partner provides, are governed by the Partner’s own terms. These Terms apply to the Research Application and to Behavix measurement only. They do not change your agreement with the Partner.

1.4 Accepting these Terms. You accept these Terms by selecting that you agree to them, in a step separate from the consent screen for measurement. If you do not agree, please do not switch on measurement.

1.5 Your privacy. Our Privacy Policy explains how we process personal data and the rights you have. Your consent to measurement is given separately, on the dedicated consent screen, and accepting these Terms does not replace that consent. If anything in these Terms conflicts with the Privacy Policy on a matter concerning personal data, the Privacy Policy prevails.

2. Eligibility

2.1 You must be at least 18 years old and have the legal capacity to enter into these Terms.

2.2 You may take part only from a country in which the Service is offered to you, and only once. You may register only on your own behalf and only on devices that you own or are authorized to use.

2.3 Employees of Behavix and of the Partners and suppliers directly involved in operating the Service, and their immediate family members, may not take part, unless we agree otherwise for testing purposes.

2.4 We may decline a registration, or limit participation by country, Partner, device type or panel size, for example to keep the panel representative.

3. How participation works

3.1 Opting in. Measurement starts only after you have accepted the dedicated consent screen and, where needed, granted the device permissions described there (for example the Android Accessibility Service, an iOS local VPN configuration or browser extension permissions).

3.2 Shared devices. Switch measurement on only on a device that you use yourself. If other people use the device, make sure that they are adults and are aware that measurement is switched on, or pause measurement while they use it.

3.3 Pausing and leaving. You can pause or stop measurement at any time in the settings of the app or extension, by withdrawing the device permission or by uninstalling the Research Application. You can also leave the Service by writing to dpo@behavix.io. Leaving does not affect your membership of the Partner’s panel.

3.4 Updates. To keep the Service working and secure, we may update the Research Application from time to time, including automatically. We will not expand the categories of data collected beyond what we have told you without updating the Privacy Policy and, where required, asking for your consent again.

3.5 Availability. We work to keep the Service running, but we do not guarantee that it will always be available or work on every device, operating system or network.

4. Licence to use the Research Application

4.1 Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the Research Application on devices you own or control, for the purpose of taking part in the Service.

4.2 The Research Application is licensed, not sold. Behavix and its licensors own all rights, including intellectual property rights, in the Service, the Research Application, our websites, our trademarks and the data products, statistics and reports that we create. These Terms do not give you any ownership in them. This does not affect your rights in your personal data under data protection law.

4.3 The licence ends when you leave the Service or these Terms end. You should then uninstall the Research Application.

5. Acceptable use

You agree not to:

(a) copy, modify, distribute, sell or rent the Research Application or any part of the Service, or create derivative works from it;

(b) decompile, reverse engineer or attempt to derive the source code of the Research Application, except to the extent permitted by mandatory law;

(c) interfere with, disable or circumvent the Research Application or its security features, or simulate activity, for example by using emulators, scripts, bots or automated tools;

(d) register more than once, register on behalf of someone else, or give false information about yourself, including your age;

(e) use the Service in a way that is unlawful, fraudulent or harmful to Behavix, the Partners or other people; or

(f) remove or alter any proprietary notices in the Service.

6. Your information and participation

6.1 Please provide accurate profile information and keep it up to date, and take part in good faith.

6.2 When you send us feedback, suggestions or ideas about the Service, you allow us to use them freely to improve the Service, without obligation to you. Your survey answers and other personal data are handled under the Privacy Policy.

6.3 In the course of research you may be shown confidential material, such as new product concepts or advertising. Please keep such material confidential and do not copy or share it.

7. Rewards

7.1 Participants may receive rewards, such as points, vouchers or prize entries, for keeping measurement switched on, usually for a minimum number of active days per month. Rewards are normally provided by the Partner under the Partner’s terms. The type and amount of the reward and the conditions for earning it are shown before you opt in.

7.2 Where Behavix provides rewards directly, the conditions, minimum amounts and redemption options are shown in the Service. We credit rewards as soon as reasonably possible. If you think a reward has not been credited correctly, please tell us within 60 days of the activity concerned.

7.3 We may withhold or cancel rewards that were obtained through fraud or by breaching these Terms, or that were credited in error.

7.4 If you leave the Service, you will no longer earn rewards. Where Behavix provides rewards directly, you can redeem rewards you have already earned within 90 days of leaving.

7.5 You are responsible for any taxes on rewards that apply to you.

7.6 Rewards you have already earned are not forfeited if we end the Service or your participation without your fault, and nothing in this section affects your statutory rights.

8. Third-party services

The Service may link to, or measure your use of, websites, apps and services operated by third parties. We are not responsible for those services, which are governed by their own terms and privacy policies.

9. Changes to the Service and to these Terms

9.1 We may change the Service, for example to add or remove features or to meet legal or platform requirements.

9.2 We may update these Terms. We will give you at least 30 days’ notice of material changes, in the app, through the Partner or by e-mail, unless the change is required sooner by law or for security reasons. If you do not agree to the change, you can leave the Service before it takes effect. Where a change requires your consent, we will ask for it, and we will not treat continued use as consent.

10. Suspension and termination

10.1 You can end these Terms at any time by leaving the Service as described in section 3.3.

10.2 We may suspend or end your participation with immediate effect if you materially breach these Terms, if we reasonably suspect fraud or misuse, or if continued participation would breach the law or the requirements of a platform provider. We may also end your participation or discontinue the Service, or the Service in a particular country or Partner, by giving you at least 30 days’ notice.

10.3 When these Terms end, measurement stops. Sections 4.2, 6.3, 7.4, 7.6, 11, 12 and 13 continue to apply.

11. Our responsibility to you

11.1 We provide the Service with reasonable care and skill. To the extent permitted by law, we do not give any other warranties about the Service, for example that it will be uninterrupted or error-free.

11.2 We are liable without limitation for damage caused intentionally or through gross negligence, for injury to life, body or health, under product liability law, and wherever liability cannot be limited under applicable law, including your rights under data protection law.

11.3 In cases of ordinary negligence, we are liable only if we breach an obligation that is essential for the proper performance of these Terms and on which you may regularly rely, and our liability is then limited to the damage that is typical for this type of contract and foreseeable at the time you accepted these Terms.

11.4 Otherwise, our liability is excluded. We are not responsible for delays or failures caused by events beyond our reasonable control, such as failures of telecommunications networks, power supply or third-party services.

11.5 These limitations also apply to the personal liability of our representatives, employees and subcontractors.

11.6 Nothing in these Terms limits any rights you have as a consumer under the mandatory law of the country where you live, including any statutory rights in respect of digital content and services, which take precedence over sections 11.3 and 11.4.

12. Governing law and disputes

12.1 These Terms are governed by the laws of Finland, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this does not deprive you of the protection of the mandatory provisions of the law of the country where you live.

12.2 We encourage you to contact us first at dpo@behavix.io so that we can try to resolve any concern. If we cannot, disputes will be decided by the District Court of Helsinki, Finland. If you are a consumer, you may also bring proceedings in the courts of the country where you live, and we may bring proceedings against you only in the courts of the country where you live. Consumers in Finland may also refer a dispute to the Consumer Disputes Board (kuluttajariita.fi).

13. General

13.1 Entire agreement. These Terms, the Privacy Policy and the information shown in the consent screen form the entire agreement between you and Behavix about the Service.

13.2 Severability. If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in force.

13.3 No waiver. If we do not enforce a right, this does not waive it.

13.4 Transfer. You may not transfer your rights under these Terms. We may transfer these Terms to another company in the Behavix group or to a successor of our business, provided that your rights are not reduced.

13.5 Notices. We may give you notices in the app, through the Partner or by e-mail. You can send notices to us at the address in section 14.

13.6 Language. These Terms may be made available in several languages. If there is a conflict, the English version prevails, unless mandatory law requires otherwise.
